GUIDELINES FOR RECORDING SANCTIONS BASED ON THE RESULTS OF FIELD INSPECTION RECOMMENDATIONS BY SUPERVISORS

Information: Before you record sanctions based on the results of field inspection recommendations, please fill in the supervision results with recommendations from the supervisor in the form of sanctions first. You can see the Routine Scheduling guide or Incidental Supervision on the site https://oss.go.id/panduan.

This Sanction Recording feature is used if the Supervision Results during the Field Inspection period are decided to impose Sanctions on Business Actors. Therefore, Supervisors are required to fill out a Supervision Results Report before continuing the Sanction Recording process and prepare a Sanction Letter to be uploaded when filling out the Sanction Recording form. To continue the process of Recording Sanctions Based on the Results of Supervisory Field Inspection Recommendations, you can follow the steps below:

1. Visit https://oss.go.id/, and select MASUK.

2. Enter your Username and Password, then click the button MASUK.

3. Enter the menu SANKSI, then select DAFTAR SANKSI.

4. When you are on the Sanction List page, you can use the search feature to search for the Sanction Data you want. Sanction data that was based on Field Inspection Recommendations, its status is displayed as "Sanction Recommendation/Rekomendasi Sanksi" with an explanation of the Sanction Source in the form of "Imposition of Administrative Sanctions as a result of Routine/Incidental Supervisory Field Inspections (adjusted to the type of Supervisory Field Inspection conducted)". To process the Sanction Data, click the 'v' sign and click UBAH. Below is an example of the display of Sanction Data based on Routine and Incidental Supervision Field Inspection Results;

5. The process of recording sanctions based on the results of field inspections, either routine or incidental inspections, does not differ from recording sanctions in general. After clicking UBAH (step 4), the system will display the Sanction Recording Form. The first part you can do is check the data of the business activity that will be sanctioned.

6. Next, check Business Actor Data which has been displayed automatically by the system.

7. Please check the Sanctioner Details displayed automatically by the system and provide a number NIP You.

8. Please fill in the Sanction Form Data. You can decide the Score and the Duration (Business Days) based on each agency's Norms, Standards, Procedures, and Criteria (NSPK).

Notes:

Scoring for recording administrative sanctions given to Business Actors in the range 1-90. The heavier the sanction, the heavier the scoring value. Meanwhile, Duration is used as a period for Business Actors to provide written responses via the OSS System.

9. The Sanction Recording Statement will be automatically checked. There are several buttons that you can use. You can select the action to take when:

Click KEMBALI to return to the List of Business Activities of Business Actors;
Click PRATINJAU CETAKAN to view the Sanction Record Printout which will be sent to Business Actors;
Click SIMPAN DRAF to save data on the sanction recording form as a draft;
Click PROSES to process data on the sanctions recording form.

10. The system will display a notification after you process the sanction recording data. If you are sure to continue the process of recording sanctions, click YA. However, if you want to cancel, click TIDAK.

11. When you are on the Sanctions List page, you can use the search feature to search for recently processed Sanctions Data. As long as the Business Actor has not responded to the sanctions imposed, the sanction status is “Sent to the Business Actors/ Terkirim ke Pelaku Usaha”. You can also see the Deadline and Validity Period, calculating the days of sanctions imposed.

When you click the 'v' sign, there are action buttons you can choose from, namely:

Click DETAIL to view the Sanction Form sent to Business Actors;
Click CETAKAN SANKSI to see the Sanction Record Printout received by the Business Actor;
Click CETAKAN NIB to see a printout of the Business Actor's Business Identification Number (NIB).

Notes:

The validity period of sanctions will be reduced until the Business Actor provides a response and the Deadline will increase (move back) by the period when the Supervisor responds to responses from Business Actors.

12. After the Business Actor responds to the sanctions, the sanctions status will change to “Waiting for Verifier Response/Menunggu Tanggapan Verifikasi”. Deadlines and Validity Periods will be temporarily suspended during this period until the Supervisor responds to Sanctions. You can check by clicking on the "v" sign and click the button MENANGGAPI.

13. After that, the system will display the Sanction Response Form. You can see responses from Business Actors in the column Note Log and can open attached documents by clicking on the link 'Lihat'. You can provide feedback to the Business Actor by filling in the Sanction Response Form.

14. Next, you can choose several actions to follow up on the Sanction Recording;

Click SANKSI DICABUT, which means that sanctions imposed on Business Actors will be revoked or restored (steps for sanction withdrawal are described in step 15);
Click SANKSI LANJUTAN, which means that Business Actors will receive further sanctions by the Supervisor (steps for advanced further sanctions are explained in step 16);
Click TANGGAPI, which means the Supervisor will send the sanctions back to the Business Actor for response (Supervisors may monitor the sanctions given to Business Actors by the explanation in step 12).

15. If you decide to remove the sanctions charged, click SANKSI DICABUT (on step 14). A Sanction removal confirmation pop-up will appear. You can click YA if you want to continue to withdraw the sanctions.

The sanction status will change to “Sanctions Removed”.

16. If you decide to charge further sanctions on business actors, click SANKSI LANJUTAN (on step 14). A Pop-up confirmation providing further sanctions will appear. You can click YA if you want to continue to charge further sanctions.

Next, the system will move the page to the Sanction Recording Form. You must fill out the Sanction Recording Form again (as explained in steps 5 to 8). In the Advanced Sanction Recording Form, there is a form Sanctions History. To see the reasons for imposing sanctions, click the 'v’ sign on previous sanctions data. You can also open an attached document by clicking the link 'Lihat Dokumen/Lihat Cetakan Sanksi’.

After filling in the form, click the button PROSES after the Statement to process further sanctions. If you want to save the Advanced Sanction Form as a draft, click the button SIMPAN DRAF.

After you process the Advanced Sanction Form, The system will create the newest sanction line on the sanctions list based on the results of filling in the Advanced Sanction Recording Form what you do with sanction status is “Sent to Business Actors/Terkirim ke Pelaku Usaha”.

Meanwhile, in the previous sanctions line, the sanctions status will change to “Continual Sanctions”. Supervisors can also view the Deadline and Validity Period and calculate the days of the Sanction as filled in on the Sanction Recording Form. When you click the 'v' sign, there are action buttons that you can choose, namely:

Click DETAIL to view the Business Actor Sanction Form;
Click CETAKAN SANKSI to see the Sanction Record Printout received by the Business Actor;
Click CETAKAN NIB to see a printout of the Business Actor's Business Identification Number (NIB).

17. When The Deadline or Validity Period has expired and the Supervisor has received no response from the Business Actor, the sanction status will change to "Business Actors Did Not Respond/Tidak Ditanggapi Pelaku Usaha" Supervisors can apply for advanced sanctions with a click 'v' sign and click DETAIL.

After clicking the DETAIL button, the system will display a Sanction Recording Form page that needs to be responded to by the Business Actor. Under the Statement column, click the button SANKSI LANJUTAN to provide advanced sanctions against Business Actors (the process for recording further sanctions is explained in step 16).

18. The following is a display of the Sanction Recording Product:

The Sanction Recording product printout will appear if you click the button CETAKAN SANKSI (step 12). The system will display the sanction upload you have completed and a QR code attachment that can be scanned.

If you scan the QR code in the Sanction Printout, you will be moved to the Sanction Details page, an example of which is as follows:

A printout of the product Business Identification Number (NIB) will appear if you click the button CETAKAN NIB (step 12).
